Coverage of construction agencies/offices of the builders as shop

The workers of construction site(s) located at non-implemented area need not be considered for coverage. Only the regular employees and other employees attached to the office located at implemented area numbering 20 or more are considered for coverage.

Thus, a Head Office or Registered Office of an Establishment is covered under ESI Act by virtue of the strength of its own employees or adding the employment strength of its branches. The branches all over India stands covered and the employees working therein are to be registered and compliance made. If the scheme has not been extended to the area in which a particular branch is located, its employees are eligible for exemption under Section 88 of the Act. Similarly, the medical and sales representatives and other touring staff who remain on tour for more then 7 months in a year are also eligible to seek exemption under this Section. 

Did you know?

A factory, or establish-ment once covered under the ESI Act, remains covered even if the number of employees at any later stage falls short of the stipulated number of 10/20 employees or the manufacturing process therein ceases to be carried on with the aid of power.
