Report
of death due to employment injury
The employer should send the
report of death to the appropriate
Branch Office and the dispensary
to which the IP was attached by
special messenger or by telephone.
IF Branch Office is closed, the
Branch Manager should be informed
at his residence, so that the
Manager can visit the place of
death to conduct an on the spot
investigation. The IMO shall also
visit, examine the body and if
considered necessary arrange for
post mortem examination
- Issue
of death certificate
Certificate will be issued
by IMO if he examines the body
or else any other Medical
Officer (Hospital /
institution that had examined
the body or attended on the
disabled person at the time of
death.
- Investigation
by the Manager
Manager will conduct
immediate investigation of the
case like any other employment
injury to obtain statement of
witnesses, their signatures, possession
of death certificate if any
issued. He will collect the
Death certificate and post
mortem certificate if
any. He will also
conduct wage verification /
obtain ESIC-32 and verify its
correctness . Further he will
ascertain the names of the
known dependants, their relationship
and obtain the supporting
documents like proof of age, certificate
of infirmity etc. duly
attested by any competent
authority.
- Action
at Branch Office
Manager will then take a
provisional decision about
death due to employment injury
on the basis of facts
disclosed in the report and
ascertained / verified during
his investigation.
Branch Office will issue
notice calling for claims from
dependants under Regulation 81
in the standard form.
- Branch
Office will examine the
eligibility of each claimant
and work out the daily rate.
If there is no proof of age
the dependant is referred to
Medical referee for assessing
the age.
- Commence
the first payment of
dependant's benefit by calling
all the dependants in person
and after satisfying their
identity.
- In
case of death / remarriage/
marriage/ attaining the age of
18 years etc. of any
dependant, payment is stopped
to that dependant and the case
is referred to Regional Office
for review of benefit.
